June 3, 2014 Opinion or Order Filing 41 MEMORANDUM AND ORDER: IT IS HEREBY ORDERED that Plaintiff CSX Transportation, Inc.'s Motion for Summary Judgment 32 is GRANTED. Judgment on Counts I and III of Plaintiff's Amended Complaint is entered in favor of Plaintiff CSX Transpor tation, Inc. and against Defendants Auburn Thirty Six LLC, and Michael Goldstein. IT IS FURTHER ORDERED that Plaintiff CSX Transportation, Inc. is awarded damages in the principal amount of $820,423.64. IT IS FURTHER ORDERED that Plaintiff CSX Transportation, Inc. is granted seven (7) days from the date of this Memorandum and Order to supplement its briefing on the issue of attorney's fees and costs. Defendants Auburn Thirty Six LLC, and Michael Goldstein are granted seven (7) to reply. IT IS FURTHER ORDERED that Defendants' counterclaim is DISMISSED.
