MEMORANDUM AND ORDER IT IS HEREBY ORDERED that plaintiffs' motion to dismiss Counts III and VI of their second amended complaint without prejudice, construed as a notice of voluntary dismissal without prejudice of Counts III and VI pursua nt to Federal Rule of Civil Procedure 41(a)(1)(A)(i), is GRANTED. IT IS FURTHER ORDERED that defendant Wells Fargo Bank, N.A.'s motion to dismiss Counts I, II, IV, V, and VII of plaintiffs' second amended complaint is GRANTED in part and DENIED in part. [Doc. 37] The motion is GRANTED as to Count I of plaintiffs' second amended complaint, and DENIED as to Counts II, IV, V, and VII of the second amended complaint.
