May 30, 2013 Opinion or Order Filing 27 MEMORANDUM AND ORDER - IT IS HEREBY ORDERED that Defendants' motion to dismiss [#22] is GRANTED without prejudice. IT IS FURTHER ORDERED that the Clerk of Court shall administratively close this case. Plaintiff shall exhaust his administrative r emedies by resubmitting his application for secondary determination to the Department or requesting a determination whether his proposed secondary employment is permitted. Defendants shall act with all deliberate speed in reviewing Plaintiff's submission and providing a final determination.
