FURTHER ORDERED that the Clerk shall not issue process or cause process to issue upon the complaint because the complai nt is legally frivolous or fails to state a claim upon which relief can be granted, or both. FURTHER ORDERED that to the extent plaintiff has brought state law claims for relief, these claims will be dismissed without prejudice pursuant to 28 U.S.C. 1367(c). FURTHER ORDERED that all other pending motions, including plaintiff's motions for contempt, are DENIED AS MOOT. An appropriate Order of Dismissal shall accompany this Memorandum and Order.
