IT IS FURTHER ORDERED that Petitioner's Motion for Leave to Proceed In F orma Pauperis is DENIED as moot. IT IS FURTHER ORDERED that, because Petitioner cannot make a substantial showing of the denial of a constitutional right, the Court will not issue a certificate of appealability. See Cox v. IT IS FURTHER ORDERED that petitioner shall either submit the motion to proceed in forma pauperis or pay the $5 filing fee within thirty (30) days from the date of this Order. IT IS FURTHER ORDERED that if petitioner fails to comply with this Order, the Court may dismiss this case without further notice. Response to Court due by 5/18/2014.. Signed by District Judge John A.
