The discussion by no means includes all of the factual disputes to be resolved based on the record before the Court. Based on this record, the Court concludes summary judgment is not appropriate. Any perceived discrepancies between Plaintiffs positions throughout the events herein go to Plaintiffs credibility and remain open to challenge at trial through cross examination.
