OPINION MEMORANDUM AND ORDER - This matter is before the Court on Defendants Motion for Summary Judgment [Doc. No. 54 ]. - The Court has discussed herein various issues of disputed fact. Such facts must be determined by the trier of fact, i.e., t he jury at trial. The discussion by no means includes all of the factual disputes to be resolved based on the record before the Court. Based on this record, the Court concludes summary judgment is not appropriate. Any perceived discrepancies between Plaintiffs positions throughout the events herein go to Plaintiffs credibility and remain open to challenge at trial through cross examination.
