MEMORANDUM AND ORDER (See Full Order) IT IS HEREBY ORDERED that plaintiff's motion for leave to proceed in forma pauperis [Doc. # 2 ] is GRANTED. IT IS FURTHER ORDERED that the Clerk shall not issue process or cause process to issue upon the c omplaint, because this Court lacks jurisdiction over the subject matter of plaintiff's claims. See Fed.R.Civ.P.12(h)(3). IT IS FURTHER ORDERED that plaintiff's motions for appointment of counsel [Doc. # 4 ] is DENIED as moot.
