MEMORANDUM AND ORDER: For the reasons discussed above, the Commissioner's decision is not based upon substantial evidence on the record as a whole and the cause is therefore remanded to the Commissioner for further consideration in accordance wi th this Memorandum and Order. Upon remand, the ALJ shall properly consider all of the opinion evidence; obtain, if necessary,additional medical evidence of Phillips' mental ability to perform work-related activity; re-assess Phillips' credibility; and formulate a new mental RFC based on the record as a whole.
