May 30, 2017 Opinion or Order Filing 57 MEMORANDUM AND ORDER: IT IS HEREBY ORDERED that plaintiff's motion for conditional certification of collective action and leave to issue class notice [Doc. # 44 ] is granted. IT IS FURTHER ORDERED that the conditionally-certified class shall include all current and former hourly-paid home healthcare workers employed at any time within the last three years at defendants St. Louis and St. Louis West branch locations. IT IS FURTHER ORDERED that defendant shall, not later than June 20, 20 17, provide plaintiffs counsel with a list of all potential class members. The list shall be provided in electronic format and shall include the name, last known residence address, phone number, email address, and dates of employment. IT IS FUR THER ORDERED that the proposed notice and consent form [Doc. #44-18] submitted by plaintiffs is approved subject to the changes discussed herein. IT IS FURTHER ORDERED that plaintiffs may send out the approved notice and consent form, and defendant shall be required to conspicuously post the notice in the break rooms at its St. Louis and St. Louis West branch locations until the opt-in period expires. June 24, 2016 Opinion or Order Filing 38 MEMORANDUM AND ORDER: IT IS HEREBY ORDERED that plaintiffs motion to compel [Doc. # 22 ] is granted in part as follows: No later than July 6, 2016, defendant shall produce the time records, pay records, Visit Timeliness Reports, and the computer re cords requested in requests for production 51, 52, and 53 that exist for five randomly selected home healthcare workers from defendants Lake Saint Louis, Missouri office. The named plaintiffs shall not be included in that random sample. Defendant sha ll produce all such records and reports created, edited, or otherwise accessed by those exemplar home healthcare workers from November 9, 2013, through November 9, 2015. Accompanying that production, defendant shall certify by sworn affidavit that it has made a diligent search for all such computer records still in existence. IT IS FURTHER ORDERED that the motion to compel is denied in all other respects. IT IS FURTHER ORDERED that defendants motion for a hearing [Doc. # 35 ] is moot. Signed by District Judge Carol E.
