May 19, 2016 Opinion or Order Filing 7 ORDER - Plaintiff has failed to comply with the Court's Order dated April 8, 2016, in which the Court ordered plaintiff to submit either the filing fee or a motion for leave to proceed in forma pauperis. As a result, this action is dismissed for failure to prosecute. Fed. R. Civ. P. 41(b). Accordingly, IT IS HEREBY ORDERED that plaintiff's complaint is DISMISSED without prejudice. April 8, 2016 Opinion or Order Filing 5 MEMORANDUM AND ORDER: IT IS HEREBY ORDERED that the Clerk shall mail to plaintiff a copy of the Court's form Prisoner Civil Rights Complaint. IT IS FURTHER ORDERED that the Clerk shall mail to plaintiff a copy of the Court 9;s Motion to Proceed in Forma Pauperis - Prisoner Cases. IT IS FURTHER ORDERED that plaintiff shall file an amended complaint on the Court provided form within thirty (30) days of the date of this Order. IT IS FURTHER ORDERED that pl aintiff shall either pay the $400 filing fee or submit a motion to proceed in forma pauperis within thirty (30) days of the date of this Order. IT IS FURTHER ORDERED that if plaintiff submits a motion to proceed in forma pauperis, he m ust also submit a certified copy of his prison account statement for the six month period immediately preceding the filing of his complaint. IT IS FURTHER ORDERED that plaintiff's motion for appointment of counsel is DENIED without prejudice. [Doc. 3 ] IT IS FURTHER ORDERED that plaintiff's motion for injunction is DENIED without prejudice. [Doc. 4 ] IT IS FURTHER ORDERED that if plaintiff fails to comply with this Order, the court will dismiss this action without prejudice.
