August 28, 2017 Opinion or Order Filing 33 MEMORANDUM AND ORDER GRANTING EAJA FEE REQUEST: IT IS HEREBY ORDERED that plaintiffs motion for attorney fees (Doc. 30 ) is GRANTED. IT IS FURTHER ORDERED that plaintiff is awarded EAJA attorney fees in the amount of $10,144.60 (52.65 hours at $192.68 hour: 51.4 hours minus 1.25 for the opinion review and plus 2.5 hours for the EAJA fee reply), subject to offset for any pre-existing debt plaintiff owes to the United States. The EAJA fee award is to be mailed to plaintiffs attorn eys address. If the EAJA fee award is offset by pre-existing debt, the Commissioner is directed to pay any remaining balance of the EAJA fee award directly to plaintiff. If the EAJA fee award is not offset by pre-existing debt, the Commissioner is directed to pay the EAJA fee award directly to plaintiffs attorney. Signed by Magistrate Judge David D. Noce on 8/28/17. May 15, 2017 Opinion or Order Filing 28 MEMORANDUM: For the reasons set forth above, pursuant to Sentence 4 of 42 U.S.C. § 405(g), the decision of the Commissioner is reversed and the case is remanded for further proceedings. On remand, the Commissioner must direct the ALJ to reeva luate the treating source's medical opinions and provide principled reasons for granting these opinions either substantial or little weight, comporting with the requirements of 20 C.F.R. § 404.1527(d)(2).
