Filing 13 MEMORANDUM AND ORDER: Accordingly, IT IS HEREBY ORDERED that the parties' Joint Motion for Relief under 28 U.S.C. § 2255 (Doc. 12 ) is GRANTED. An amended judgment will be entered in United States v. Hopkins, No. 4:88-cr-00245-JAR-2. Th is Memorandum and Order does not disturb the life sentence imposed on Hopkins in United States v. Hopkins, No. 4:91-cr-00001-CDP-9 (E.D.Mo.). Hopkins shall remain in the custody of the Federal Bureau of Prisons.IT IS FURTHER ORDERED that the Clerk of Court is directed to docket a copy of this Memorandum and Order in United States v. Hopkins, No. 4:88-cr-00245-JAR-2; and United States v. Hopkins, No. 4:91-cr-00001-CDP-9 (E.D. IT IS FURTHER ORDERED the Clerk of Court is directed to forward a copy of mo vant's § 2255 motion to the Office of the Public Defender for the Eastern District of Missouri. IT IS FURTHER ORDERED that the Public Defender shall notify this Court, within forty-five (45) days of the date of this Memorandum and Order, whether it will be pursuing movants arguments under Johnson, either by filing a written notice in this action of their intent not to represent movant, or by filing an amended motion to vacate, brought pursuant to 28 U.S.C. § 2255, also in thi s action, or a request in the Court of Appeals for leave to bring a successive § 2255 motion, as required by 28 U.S.C. § 2244(b)(3).
