MEMORANDUM AND ORDER: IT IS HEREBY ORDERED that plaintiffs motion to proceed in forma pauperis (Docket No. 3 ) is GRANTED. IT IS FURTHER ORDERED that plaintiff must pay an initial filing fee of $3.90 within thirty (30) days of the date of th is Order. Plaintiff is instructed to make his remittance payable to "Clerk, United States District Court," and to include upon it: (1) his name; (2) his prison registration number; (3) this case number; and (4) the statement that the rem ittance is for an original proceeding. IT IS FURTHER ORDERED that plaintiffs Motion for Courts to Grant Motion for Plaintiff Leave to Proceed informa pauperis (Docket No. 14 ) is DENIED as moot. IT IS FURTHER ORDERED that this case is DISMISSED with out prejudice. A separate order of dismissal will be entered herewith. IT IS FURTHER ORDERED that plaintiffs motion to appoint counsel (Docket No. 2 ) is DENIED as moot. IT IS HEREBY CERTIFIED that an appeal from this dismissal would not be taken in good faith..
