Filing 29 MEMORANDUM AND ORDER IT IS HEREBY ORDERED that defendant Dr. Loynd's motion to dismiss is GRANTED in part and DENIED in part. The motion is granted as to plaintiff's medical malpractice claims brought under Missouri state law, and deni ed in all other respects. [ECF No. 21 ] IT IS FURTHER ORDERED that plaintiff's motion for appointment of counsel is DENIED without prejudice. [ECF No. 23 ] IT IS FURTHER ORDERED that plaintiff's motion to subpoena medical inquiries is DE NIED. [ECF No. 24 ] IT IS FURTHER ORDERED that plaintiff's motion requesting a personal recognizance bond because of medical issues is DENIED as moot as plaintiff has been released from St. Charles County Jail. [ECF No. 24 ]. IT IS FURTHER OR DERED that the Clerk of Court shall substitute Jandi Cox for defendant Jandi Unknown on the docket sheet. Filing 10 MEMORANDUM AND ORDER - IT IS HEREBY ORDERED that plaintiff's motion to proceed in forma pauperis is GRANTED. [ECF No. 2] IT IS FURTHER ORDERED that the plaintiff shall pay an initial filing fee of $1.00 within thirty (30) days of the da te of this Order. Plaintiff is instructed to make his remittance payable to "Clerk, United States District Court," and to include upon it: (1) his name; (2) his prison registration number; (3) the case number; and (4) that the remittance is for an original proceeding. IT IS FURTHER ORDERED that the Clerk shall issue process or cause process to issue upon the complaint as to plaintiff's claims under 42 U.S.C. § 1983 alleging defendants Debbie Echele, Jessica Richard, Ther esa Martin, and Nurse Jandi [Unknown] violated his First Amendment rights. IT IS FURTHER ORDERED that the Clerk shall issue process or cause process to issue upon the complaint as to plaintiff's claims under 42 U.S.C. § 1983 alleging defe ndants Debbie Echele, Dr. Loynd, and Nurse Jandi [Unknown] violated his Eighth Amendment rights and committed medical negligence under Missouri state law. IT IS FURTHER ORDERED that plaintiffs claims alleging civil conspiracy, violations of the Ame ricans with Disabilities Act, "Monell" claim, and state law claim for intentional infliction of emotional distress are DISMISSED without prejudice. IT IS FURTHER ORDERED that plaintiff's claims against defendant Scott A.
