Docket Text ORDER: On March 26, 2021, the Court ordered Defendant SharkNinja Operating, LLC. to disclose the citizenship of each of its members. Doc 9. Defendant SharkNinja Operating, LLC. has not filed a response to the Court's order. Accordingly, no later than April 16, 2021, SharkNinja Operating, LLC. must disclose the citizenship of each of its members pursuant to the Court's prior order, see Doc. 9. Failure to comply with this order will result in this case being remanded back to state court for lack of subject matter jurisdiction. (Amended/Supplemental Pleadings due by 4/16/2021.) ORDER: Accordingly, the Court orders SharkNinja Operating, LLC. to disclose the citizenship of each of its members. Additionally, although [the Eighth Circuit] has not yet specifically addressed whether the citizenship of sub-members is relevant to establishing diversity citizenship, other federal courts addressing this issue have explained that the Court not only need to know the citizenship of each member of the LLC, but also the citizenship of any sub-member. See Clark v. SL W. Lounge, LLC, No. 4:18-CV-01223-JCH, 2019 WL 527781, at *2 (E.D. Mo. Feb. 11, 2019). Thus, in addition to disclosing the citizenship of its own members, SharkNinja Operating, LLC. must also disclose the citizenship of all sub-members. For purposes of clarity, sub-members includes the members of members (i.e. first-tier submembers), and the members of first-tier sub-members (i.e. second-tier sub-members), the members of second-tier sub-members (i.e. third-tier sub-members), and so on until it has disclosed the citizenship of all persons and entities within its ownership structure.
