ORDER OF DISMISSAL. This matter is before the Court on the parties' Joint Stipulation of Dismissal Without Prejudice. (Doc. #10 ). Plaintiff Charlene M. Smith and Defendant Progressive Direct Auto Insurance Company have agreed to dismiss this action without prejudice pursuant to Fed. R. Civ. P. 41(a)(1) (A)(ii), with each party to bear its own costs and fees. Accordingly, IT IS HEREBY ORDERED that this matter is DISMISSED without prejudice, with each party to bear its own costs and fees.
