Plaintiff Fontania Lawrence initially filed this case in state court in December of 2020. It is now September of 2022, and this Court questions whether it has jurisdiction given 28 U.S.C. 1446s one-year limit on certain removals. The Court orders further briefing on the issue as follows. Defendants must show in writing, by no later than October 3, 2022, why the Court should not remand this case for lack of jurisdiction under 28 U.S.C. 1332 and 1446. Plaintiff must respond by no later than October 11, 2022. The parties may address any relevant considerations, including timeliness and whether "the case stated by the initial pleading [was] not removable." 28 U.S.C. 1446(b)(3).
