Filing 15 ORDER: Plaintiff Angela Fischer has attempted to dismiss this action under Rule 41(a)(1) of the Federal Rules of Civil Procedure. But that Rule states: "[T]he plaintiff may dismiss an action without a court order by filing a notice of dismissal before the opposing party serves either an answer or a motion for summary judgment." Fed. R. Civ. P. 41(a)(1)(A)(i) (emphasis added). Defendant Sazerac Company, Inc., has filed a motion for summary judgment, Doc. 11, so Rule 41(a)(1)(A)(i) does not apply and Plaintiffs notice, Doc. 14, is a nullity. Instead, the Federal Rules contemplate "a stipulation of dismissal signed by all parties who have appeared" at this stage, Fed. R. Civ. P. 41(a)(1)(A)(ii), or a motion under Rule 41(a)(2). Because Plaintiff filed a notice under Rule 41(a)(1) (A)(i), rather than a stipulation under Rule 41(a)(1)(A)(ii) or motion under Rule 41(a)(2), this case remains live, and Local Rule 4.01 continues to govern the response deadlines to Defendants motions, Docs. 8, 11.
