MEMORANDUM AND ORDER...IT IS HEREBY ORDERED that plaintiff's motion to proceed in forma pauperis [ECF No. #2 ] is GRANTED. IT IS FURTHER ORDERED that plaintiff shall pay an initial filing fee of $55.54 within thirty (30) days of the date of this Order. Plaintiff is instructed to make his remittance payable to "Clerk, United States District Court," and to include upon it: (1) his name; (2) his prison registration number; (3) the case number; and (4) that the remittance is for an original proceeding. IT IS FURTHER ORDERED that in accordance with 28 U.S.C. 1915(e)(1), counsel is appointed in this matter. The Court appoints: Jeffrey R. Fink, THOMPSON COBURN LLP - St. Louis, One US Bank Plaza, Suite 2700, St. Louis, MO 63101, as counsel for plaintiff. IT IS FURTHER ORDERED that within forty-five (45) days of the date of this Memorandum and Order, appointed counsel shall submit an amended complaint in this matter. Because plaintiff is proceeding in forma pauperis, the Court will effectuate service of process after reviewing the amended complaint pursuant to 28 U.S.C. 1915 for frivolousness, maliciousness and failure to state a claim.
