OPINION AND ORDER, IT IS ORDERED that Northern Plains 33 MOTION for Summary Judgment is GRANTED as to Count IV of the Complaint for the reasons discussed above, but DENIED in every other aspect. BLM's and Signal Peak's 40 C ross MOTION for Summary Judgment are DENIED as to Count IV of the Complaint for the reasons discussed above, but GRANTED in every other aspect. This case is REMANDED back to the Interior Board of Land Appeals for consideration of Northern Plains' argument that BLM's discussion of alternatives in the EA is inadequate. Signed by Judge Susan P.
