Filing 5 ORDERED: Zindells motion to proceed IFP (Doc. 2) is GRANTED. The Clerk ofCourt is directed to waive payment of the filing fee. Within 60 days of this Order, Zindell may respond by filing a brief of no more than ten (10) pages, excluding any exhibits, showing cause why his federal petition should not be dismissed with prejudice. Zindell should address both the procedural default and statute of limitations. Failure to timely respond to this Order will result in dismissal of the petition with prejudice. Zindell must immediately notify the Court of any change in his mailing address by filing a Notice of Change of Address. Failure to do so may result in dismissal of his case without notice to him.
