ORDER that petition is DISMISSED without prejudice. IT IS FURTHER ORDERED that 2 Petitioner's Emergency Motion for Stay of Deportation is DENIED. Certificate of Appealability is DENIED. Clerk of Court shall serve a copy of petition and this order upon respondents as as directed in this order.
