Filing 3 MINUTE ORDER IN CHAMBERS of the Honorable Chief Judge Miranda M. Du on 9/12/2022. On September 6, 2022, Plaintiff Seanah Dixon filed an application to proceed in forma pauperis ("IFP") and a civil-rights complaint under 42 U.S.C. 1983, which she identifies as "emergency" filings that concern the "imminent threat of [her] death." (ECF Nos. #1 , [1-1].) Among other things, Dixon alleges that David Rivas and Michael Minev were deliberately indifferent to her need to see a neurological specialist for her heart condition. This claim appears to duplicate parts of a claim that Dixon brings in another lawsuit she filed before filing this action, which is styled Seanah J. Dixon v. Stacy Barrett, 2:22-cv-01412-APG-DJA ("Dixon I"). The Court takes judicial notice of the record in Dixon I under Federal Rule of Evidence 201. The Court in Dixon I recently entered a screening order at ECF No. 4, allowing Dixon's Eighth Amendment deliberate-medical-indifference claim to proceed against David Rivas and Michael Minev, among others. The Dixon I Court also noted that it would enter a separate order on the motions for a temporary restraining order and preliminary injunction that Dixon filed in that case.Based on the similarities between the medical-indifference claims pled in this action and Dixon I and the procedural posture of Dixon I, the Court does not find that Dixon's complaint and IFP application in this case constitute an emergency. The Court will therefore screen the complaint in the ordinary course and not on an emergency basis. (no image attached) (Copies have been distributed pursuant to the NEF - XC) |
