Text of Order: Defendant Pearl River's letter filed this morning (doc. no. #32 ) is not well received by the court. Counsel for both parties conducted themselves in a highly professional manner during a productive and efficient conference with the court on April 30, 2020. During that conference, the court specifically asked defense counsel if Pearl River would agree to the process outlined in the court's order following the conference. And on May 7, the parties jointly filed a stipulation agreeing to conduct narrow discovery (doc. no. #31 ). Contrary to Pearl River's new position, the court did not order the parties to stipulate; only to negotiate, and to file a stipulation on the issues to which they mutually agreed. Pearl River's letter, which violates Local Rule 7.1 by seeking relief outside the contours of an appropriate motion, is inconsistent with that position. The stipulation stands. The court will take up the motion to dismiss at the preliminary injunction hearing. The Motion to Strike (Doc. #34 ) is denied as moot. So Ordered by Judge Joseph N. Laplante.(jb)

Text of Order: As discussed during today's video conference, the parties shall negotiate an expedited exchange of the information and documents that each party requires for its oral argument on whether plaintiff is entitled to preliminary injunctive relief. On or before May 7, 2020, the parties shall file a stipulation describing the scope and manner of that discovery.
