Text of Order: Phillip Roberts has filed a Request/Motion to Construe for Proper Filing (Doc. No. 3) indicating that he believes this action should proceed under 28 U.S.C. 2241, rather than as a civil rights action or a request to proceed under Fed. R. Civ. P. 60(b). The motion is GRANTED, as follows: (1) Mr. Roberts's initial filing (Doc. No. 1) is construed as a 2241 petition and the clerks office is directed to amend the docket accordingly; (2) the Clerks office is further directed to send Mr. Roberts (a) a blank 2241 form to complete and file, and (b) new paperwork reflecting the appropriate filing fee ($5.00) for a habeas action filed in this court.
