April 12, 2022 Opinion or Order ENDORSED ORDER granting #3 Motion to Supplement Pending Habeas Corpus; denying #4 Motion to Issue Writ Order to Show Cause. Text of Order: Petitioner Terence Crawley has filed a motion (Doc. No. 3), requesting that the court allow him to supplement his petition. Without comment on the merits of any claim asserted by the petitioner in this case, the motion to supplement (Doc. No. 3) is GRANTED and will be considered part of the petition for all purposes. Mr. Crawley has also filed a "Motion to Issue Writ Order to Show Cause" (Doc. No. 4), asking the court "to issue an order requiring the defendant to respond to" his petition. Doc. No. 4 at 1. Habeas petitioners may ask the court to direct another party to demonstrate a basis for that party's failure to comply with some legal requirement, but because there is no other party in this case at the time of Mr. Crawley's motion, no defendant has accrued and failed to comply with a legal obligation. Accordingly, Mr. Crawley's Motion to Issue Writ Order to Show Cause (Doc. No. 4) is DENIED. So Ordered by Magistrate Judge Andrea K. Johnstone.(lw)
