May 6, 2022 Opinion or Order ENDORSED ORDER re: #1 Complaint for Injunctive Relief. Text of Order: The plaintiff in this matter, Luis Pitt, submitted a filing (Doc. No. 1) to this Court which the Court has construed as the complaint a civil rights action alleging that Mr. Pitt, who is incarcerated at FCI Berlin, has been denied access to his legal materials which he claims he needs to file a 28 U.S.C. 2255 motion regarding his sentence. Mr. Pitt has included a request for preliminary injunctive relief in his complaint (Doc. No. 1). Mr. Pitt has not yet paid the filing fee or applied for in forma pauperis status in this case, and the Clerk's office has set a July 7, 2022 deadline for Mr. Pitt to do one or the other. The court finds that Mr. Pitts request for preliminary injunctive relief may be adequately addressed when this Court conducts preliminary review of this case in the normal course, after he has paid the filing fee or obtained in forma pauperis status in this case.
