December 8, 2022 ENDORSED REPORT AND RECOMMENDATION re: #1 Complaint. On November 14, 2022, the plaintiff was directed either to pay the filing fee or properly apply to proceed in forma pauperis on or before December 1, 2022. The plaintiff has done neither. The undersigned Magistrate Judge therefore recommends that this case be dismissed without prejudice. Any objections to this Report and Recommendation must be filed within fourteen days of receipt of this notice. See Fed. R. Civ. P. 72(b)(2). The fourteen-day period may be extended upon motion. Only those issues raised in the objection(s) to this Report and Recommendation are subject to review in the district court. See Sch. Union No. 37 v. United Nat'l Ins. Co., 617 F.3d 554, 564 (1st Cir. 2010). Any issues not preserved by such objection(s) are precluded on appeal. See id. November 14, 2022 Opinion or Order ENDORSED ORDER denying without prejudice #3 Motion to Proceed Without Prepayment of Fees or Costs.. Text of Order: Plaintiff represents he has zero income and zero debt and presents various comments on the financial affidavit that make it apparent he is not providing the financial information called for by the financial affidavit. This does not represent a good faith response to the questions posed in the financial affidavit and renders it impossible to determine if the plaintiff qualifies for in forma pauperis status. Thus, the request is denied without prejudice. The court will take no further action in this matter until the plaintiff pays the filing fee or is granted in forma pauperis status. Plaintiff is directed to pay the filing fee or submit his application to proceed in forma pauperis by December 1, 2022, or this matter may be dismissed without prejudice.
