TEXT ORDER THIS MATTER comes before the Court upon a letter submitted by Comcast Corporation and Comcast Holdings Corporation, requesting a pre-motion conference in regard to a proposed Motion to Dismiss in Lieu of an Answer to Dismiss Plaintiff Gabriella Guzman's Complaint with Prejudice. Dkt. No. 7. Having read the submissions by the parties, including Plaintiff Gabriella Guzman's response, Dkt. No. 9, the Court does not believe that a pre-motion conference would be productive at this time. The Court will also strike the language "Count III" from the Complaint as agreed by Plaintiff Gabriella Guzman. Therefore, Defendants may proceed with filing their proposed motion with respect to Count I and Count II if they choose to do so. Pursuant to Fed. R. Civ. P. 11, the Court expects that any motion filed by Plaintiff in opposition to Defendants' proposed motion will contain case law sufficient to establish that Plaintiff's claims "are warranted by existing law or by a nonfrivolous argument for extending, modifying, or reversing existing law or for establishing new law." TEXT ORDER This matter comes before the Court upon the pre-motion conference letter filed by Defendants [Docket No.7] and Plaintiff's failure to comply with the Court's Individual Rules and Procedures. Specifically, Plaintiff has failed to respond to Defendants' letter within five (5) business days as required by Rule I.A of this Court's Individual Rules and Procedures. It is hereby ORDERED that Plaintiff shall show cause before this Court within three (3) business days why she has failed to timely respond AND why the relief Defendant seeks in its pre-motion letter should not be granted.
