Filing 5 MOTION for Leave to Appear Pro Hac Vice by DONYONNA S. STRONG. (NESEVICH, RUSS) |
Filing 4 TEXT ORDER terminating #3 Motion for Leave to Appear Pro Hac Vice This matter comes before the Court upon a purported motion for leave to appear pro hac vice filed by counsel for Plaintiff. [Docket No. 3.] The Court denies the Motion without prejudice. First, counsel did not include any actual motion for the Court to decide. Rather, he submitted only a "Certification Supplementing Application for Admission pro hac vice" certifying that he is a good standing member of the Missouri and Illinois State Bars. An application for appearance pro hac vice must be made as a formal motion by an attorney admitted to practice before this Court. See L. Civ. R. 101.1(c) (specifying that entering an appearance pro hac vice must be made upon motion); see also L. Civ. R. 101.1(a) ("The bar of this Court shall consist of those persons heretofore admitted to practice in this Court and those who may hereafter be admitted in accordance with these Rules."). Second, the Certification does not itself comply with Local Civil Rule 101.1(c) governing the admission of attorneys pro hac vice because it fails to certify that "no disciplinary proceedings are pending against the attorney in any jurisdiction and no discipline has previously been imposed on the attorney in any jurisdiction." See L. Civ. R. 101.1(c)(1). The Clerk of Court is directed to terminate the Motion. Signed by Chief Judge Renee Marie Bumb on 12/20/2023. (Costigan, Roberta) |
