TEXT ORDER This matter comes before the Court upon the Pre-Motion Letters filed by Plaintiff Healthcare Justice Coalition of New Jersey Corp. ("Plaintiff"), [Docket No. 7], and Defendants Horizon Healthcare Services, Inc. d/b/a Horizon Blue Cross Blue Shield of New Jersey and Horizon Healthcare of New Jersey d/b/a Horizon NJ Health (together, "Horizon"), [Docket No. 12], concerning a proposed Motion to Remand by Plaintiff. Given Horizon's willingness to litigate this matter in state court so long as Plaintiff "execute[s] a stipulation [] provid[ing] that Plaintiff will not seek relief and [] waive[s] any right to claims relating to services rendered to FEHBA enrollees," the Court directs the parties to first meet and confer regarding whether such an agreement is possible. Within fourteen (14) days of this Order, the parties shall execute and file such an agreement or submit a joint letter explaining that they failed to reach an agreement. If the parties fail to reach an agreement, the Court will either hold a pre-motion conference or direct Plaintiff to file its proposed Motion to Remand.
