Filing 6 MEMORANDUM OPINION AND ORDER directing the Clerk to reopen this matter & cv-10-1945, by making a new & separate entry "CIVIL CASE REOPENED". For the purposes of Johnson v. Mash, cv-10-1630 & Johnson v. Mash cv-10-1945, Pltf's letter sh all be deemed mis-docketed as a result of Pltf's own erroneous to all three matters. The Clerk shall docket this Memorandum Opinion & Order in Johnson v. Mash in cv-10-1630 and also make a new & separate entry on the docket of that matter readin g "DOCKET ENTRY NO. 5 IS DEEMED STRICKEN FROM THE DOCKET AS MIS-DOCKETED DUE TO PLAINTIFF'S ERROR IN DESIGNATING THE RELEVANT INDEX NUMBER OF HIS ACTION"; plaintiff shall not make any further submissions associated with his challanges raised in the Instant Matter. For the purposes of the Instant Matter, Plaintiff's letter DE#8 is construed as Plaintiff's first amended complaint. Plaintiff's first amended complaint is dismissed for failure to state a claim, & the Cle rk shall administratively terminate the Instant Matter cv-10-1630 and cv-10-1945 and make a new and separate entry "CIVIL CASE TERMINATED". Plaintiff may have the Instant Matter reopened if, w/in 45 days, he filed his second amended complaint detailing solely the facts of his "phone list" and ETS claims; etc. Signed by Judge Faith S.
