Filing 28 OPINION AND ORDER - Based on the foregoing, Defendants' motion to transfer to the Eastern District of Pennsylvania 22 is DENIED. Because venue is proper in the District of New Jersey, Defendants may only seek discretionary transfer under 28 U. S.C. 1404(a). A discretionary transfer to the Eastern District of Pennsylvania would be inappropriate because Defendants have failed to demonstrate that the relevant private and public interest factors, which the United States Court of Appeals articu lated in Jumara, weigh in favor of a transfer. In addition, for the reasons discussed above, Defendants' application to reassign this action the Trenton Vicinage is DENIED WITHOUT PREJUDICE to Defendants' right to make an appropriate application to the Chief Judge pursuant to Local Rule 40.1. Signed by Magistrate Judge Joseph A. Dickson on 8/3/2015. (anr) |
