December 15, 2020 Opinion or Order Filing 211 TEXT ORDER: The Court has considered the parties' joint status report and the Defendants' letter memorandum seeking a stay of proceedings pending resolution of certain matters pending before the Federal Maritime Commission [D.E. 209-210]. First, the Defendants' request for leave to file a formal motion to stay is denied, insofar as Defendants' December 9th memorandum [D.E. 210] already sets forth the basis for Defendants' request, and no further briefing is required on an issue with which the Court is well familiar. The Court will take Defendants' request under advisement. However, in the interim, it is this Court's intention to refer this matter to outside mediation, as is within this Court's discretion. Accordingly, the parties are directed to meet and confer to see if they can agree on a mediator. If the parties cannot reach agreement, they shall each submit three proposed mediator's for the Court's consideration, and the Court will either pick one of those mediators or a mediator of the Court's choosing.
