Filing 8 ORDER Granting #6 Letter by STEVENS, NICHOLAS requesting Pro Hac Vice admission of Richard H. Baron, Esq., etc. Signed by Magistrate Judge Mark Falk on 8/29/2018. (JB, ) |
Filing 7 TEXT ORDER: The Court is in receipt of the parties' "Stipulation as to Revised Briefing" (ECF No. 5), which suggests that the parties may extend the briefing schedule for the pending motion for a preliminary injunction (ECF No. 3) by two motion cycles without the permission of the Court. The parties apparently have not reviewed the Local Civil Rules for the District of New Jersey and do not adequately comprehend motion practice in this Court. Local Rule 7.1(d)(5) provides that an opposing party to a motion may adjourn the motion date one cycle without the permission of its adversary or the Court; however, any further extension must be granted by the Court at the request of the party seeking the extension. See Local Civ. R. 7.1(d)(5). Any such extension request may be made by filing a letter indicating the desired motion date, the parties' consent and the reasons underlying the request. Consequently, the Court treats the parties' instant "Stipulation" as an automatic extension under Rule 7.1(d)(5). The new motion date for the pending motion for a preliminary injunction is October 1, 2018. Defendants' opposition is due no later September 17, 2018 and Plaintiff's reply is due no later than September 24, 2018. Should the parties wish to extend the motion cycle further, they must file the appropriate letter to the Court, explaining their reasons for the extension. So Ordered by Judge William J. Martini on 8/29/18. (gh, ) |
