OPINION & ORDER re: #8 MOTION to Dismiss or, Alternatively, Transfer to the District of New Jersey. filed by William Barr, James McHenry, Kevin K. McAleenan, Thomas Decker. Because Sanchez was confined in New Jersey at the time he filed this petition, and because the warden of the Hudson County Correctional Facility in New Jersey is the proper respondent, this Court lacks jurisdiction over Sanchez's habeas petition. Accordingly, the Court transfers this petition to the District of New Jersey pursuant to 28 U.S.C. 1406(a). The Clerk of Court is respectfully directed to terminate all open motions and transfer this case to the United States District Court for the District of New Jersey. To minimize any delay, the Court waives the seven-day waiting period contained in Local Civil Rule 83.1, and respectfully directs the Clerk to effectuate the transfer as soon as possible.
