March 6, 2020 Opinion or Order Filing 3 TEXT ORDER: The Court is in receipt of Petitioner Robert Ryders Petition and Motion to confirm an arbitration award. ECF Nos. 1-2. As the award does not appear to specify the court in which judgment should be entered, see ECF No. 1, Ex. 1, service must be effectuated before the Court will enter such a judgment. 9 U.S.C. 9 (If no court is specified in the agreement of the parties, then such application may be made to the United States court in and for the district within which such award was made. Notice of the application shall be served upon the adverse party, and thereupon the court shall have jurisdiction of such party as though he had appeared generally in the proceeding.). Petitioners only evidenced service of their motion, and not their petition, by email and regular mail to an attorney that appeared to represent Respondent in the underlying arbitration but has not appeared in this case. Accordingly, service has not been effectuated. See FRCP 4. Once Petitioner evidences proper service (or evidences Respondents waiver of service by some means other than Petitioners counsels say-so), the Court will consider the pending motion.
