ORDER that Plaintiff's application to proceed in forma pauperis is Granted; the Complaint #1 shall be filed; Plaintiff's deliberate indifference to medical needs and state law medical malpractice claims shall Proceed against Defendants Connolly and Pomerantz only at this time; Plaintiff's claims against the New Jersey Department of Corrections Central Transportation Unit are Dismissed With Prejudice; Plaintiff's claims against the remaining Defendants are Dismissed Without Prejudice; the Clerk of the Court shall issue summons, and the United States Marshal shall serve a copy of the complaint #1 summons and this order upon Defendants Connolly and Pomerantz with all costs of service advanced by the United States; Defendants shall file and serve a responsive pleading within the time specified in Federal Rule of Civil Procedure 12; Plaintiff's request for the appointment of counsel is Granted; once appointed, counsel for Plaintiff shall be permitted to file an amended complaint addressing the deficiencies as to the dismissed Defendants within 30 days; the Clerk shall serve a copy of this Order upon plaintiff by regular mail.
