Filing 3 TEXT ORDER: The notice of removal asserts that this Court may hear this case on the basis of diversity jurisdiction, which requires Plaintiff to be completely diverse from each Defendant. The citizenship information provided as to defendants Reinhart Transportation, LLC and Reinhart FoodService, L.L.C., which appear to be limited liability companies, is insufficient to determine if complete diversity of citizenship exists, and thus whether this Court has subject matter jurisdiction. Defendants are hereby ORDERED to electronically file letters completely analyzing the citizenship of the two aforementioned defendants with specificity by FRIDAY, AUGUST 28, 2020. Defendants must comply with the standing order of this Court as to pleading the citizenship of unincorporated business organizations, which can be found at: https://www.njd.uscourts.gov/content/edward-s-kiel. Further, the Court advises that an allegation such as "none of the members were citizens of New Jersey when this action was commenced, nor are they currently citizens of New Jersey" lacks the required specificity. The parties shall also refrain from filing any dispositive motions until such time as this Court determines jurisdiction. So Ordered by Magistrate Judge Edward S. Kiel on 8/18/2020. (as, ) |
