TEXT ORDER: This matter was removed from state court to this federal court based on its federal-question jurisdiction. 28 U.S.C. 1331. The amended complaint asserts at least one claim under federal law, specifically, the Fair Trade Commission Act (the "FTCA"), 15 U.S.C. 45(a)(1) (Count IV). The plaintiff has filed with the court a letter recounting frustrations in attempting to file and serve the complaint. The notice of removal itself, however, states that the defendant has accepted service of the amended complaint. (Notice of Removal, DE 1 at 2 3) Plaintiff also objects that "the state court can handle violations of those two (2) federal statutes." (DE 5 at 4) That is not a basis for remand of a properly removed case, but if the plaintiff seeks remand of the action to state court on other grounds, he must do so via a properly noticed motion.
