ENDORSED ORDER granting #8 Unopposed Motion for Clarification and Notice of Potential Exception Under Local Rule 3.02(d). The Court clarifies that a Notice of Exception is required in any case that involves only ERISA claims. Because Defendant's Answer, and any potential counterclaim(s), may include non-ERISA claims, it is currently unclear whether a Notice of Exception is appropriate. After Defendant files its Answer, and any potential counterclaim(s), the parties must jointly determine whether a Notice of Exception is required. Such a filing will be required if the case contains only ERISA claims, regardless of which standard of review will apply. The Court DIRECTS the parties to file the Notice of Exception, if appropriate, within 14 days of the service of Defendant's Answer. If the Court agrees with the parties' assessment, an Order will be issued directing the parties to file an appropriate Case Management Report. If the Court disagrees, an Order will be issued setting this case for a Preliminary Pretrial Conference and directing the parties to file a Uniform Case Management Report by a date certain.
