January 3, 2022 Opinion or Order Filing 3 ORDER that Plaintiffs application to proceed in forma pauperis under 28 U.S.C. 1915(a) (ECF 1-3) is GRANTED; the Clerk shall file the complaint (ECF 1 and 1-2), but summons shall not issue; pursuant to 28 U.S.C. 1915(b) and for purposes of account deduction only, the Clerk shall serve a copy of this Order by regular mail upon the Attorney General of the State of New Jersey, and the warden of the Bergen County Jail; Plaintiff is assessed a filing fee of $350.00 and shall pay the entire filing fee in the manner set forth in this Order; the complaint (ECF 1, 1-2) is DISMISSED without prejudice for failure to state a claim pursuant to 28 U.S.C. 1915(e)(2)(B); Plaintiff is granted leave to file an amended complaint, within 30 days of the date of entry of this order, if he can cure the deficiencies in his claims described in the accompanying Memorandum Opinion; the Clerk of the Court shall serve a copy of this Order and the accompanying Memorandum Opinion upon Plaintiff by regular mail, and shall CLOSE the file, subject to reopening upon the timely filing of an amended complaint.
