TEXT ORDER: As to Defendant Tranes removal in this matter, and without reaching any other issues raised, the Court order the parties to submit a letter brief as to whether service on Defendants F. Greek Development Inc. (FGDI) and Three Cubed, LLC was proper under the New Jersey Rules of Court. The temporary restraining order entered by the Hon. Thomas Daniel McCloskey, J.S.C. provided for service in a particular manner. D.E. 1-2. However, New Jersey Rule of Court 4:4-4(b)(3) does not appear to permit electronic service is the first instance (and even then, such service would have to be consistent with due process of law.). No later than March 18, 2022, Plaintiffs shall submit a letter on the docket demonstrating that service was proper under New Jersey law. Defendant Trane shall file it opposition no later than March 22, 2022. In light of 28 U.S.C. 1441(b)(2), the Court is no longer inquiring whether FGDI and Three Cubed consented to removal.
