ORDER GRANTING STIPULATION TO EXTEND TIME TO RESPOND TO INITIAL COMPLAINT, #19 Judge Sunshine Suzanne Sykes: PURSUANT TO STIPULATION, IT IS SO ORDERED:1. Plaintiff filed this action against Defendants Samsung Electronics America, Inc. (SEA) and Samsung Electronics Co., Ltd (SEC) (together, Defendants). SEA was served by hand on July 20, 2022. SEAs current deadline for responding to the Complaint is August 10, 2022. 2. SEC has not been served. SEC is headquartered in South Korea. If SEC does not agree to waive service, Plaintiff will have to serve SEC via the Hague Convention, which process may take several months. 3. In the interests of efficiency, SEC has agreed that it will waive service of process if Plaintiff will agree to a 120-day extension of SEAs current deadline for responding to the Complaint. The extended deadline would thereafter also be SECs deadline for responding to the Complaint. 4. Pursuant to the parties agreement of a 120-day extension, Defendants will have a unified response deadline of December 8, 2022. 5. Pursuant to the parties agreement, Plaintiff shall file any amendment to his Complaint by November 8, 2022. 6. IT IS FURTHER ORDERED that this Order Granting the Stipulation to Extend Time to Respond to the Initial Complaint does not constitute a waiver of any claim, right, or defense. (shb)
