By December 19, 2022, declarations are ordered to be filed by: (1) plaintiff Homesite Insurance Company (Homesite) declaring whether direct relief is sought for Chet Stojanovich, and whether his citizenship must be pleaded; (2) Homesite and defendant Lemonade Insurance Company (Lemonade) declaring the nature of their organizations, and then completely analyzing their respective citizenships in compliance with either the # standing order if they are unincorporated business organizations or 28 U.S.C. (Section) 1332(c)(1) if they are corporations; and (3) Lemonade declaring defendant Oz Moving & Storage, Inc.'s (Oz) complete citizenship under Section 1332(c)(1). Also, Homesite is advised that: (1) Oz was served and has answered in state court; and (2) the action may have been removed in violation of the forum-defendant bar, see Section 1441(b)(2), and the rule of unanimity, see First Am. Title Ins. Corp. v. JPMorgan Chase & Co., 384 F.App'x 64, 66 (3d Cir. 2010). Therefore, Homesite is directed to file by January 9, 2023, either a motion to remand or a stipulation to remand with defendants, if appropriate. So Ordered by Magistrate Judge Edward S.
