On 2/22/2023, this Court issued a decision and order finding that United Airlines' motion to dismiss would be granted unless Schenck filed an amended complaint that adequately demonstrated personal jurisdiction over United Airlines. Docket Item 43. Schenck then filed an amended complaint, Docket Item 51, and moved to transfer the case to the United States District Court for the District of New Jersey under 28 U.S.C. 1406, Docket Item 52. Schenck's motion appears to establish that venue is appropriate in the District of New Jersey, see Docket Item 52-2 at 2-3, and United Airlines does not oppose Schenck's motion to transfer, Docket Item 53. At this stage, the Court lacks sufficient information to consider the factors stated in Hodge. The plaintiff's request for appointment of counsel therefore is denied without prejudice as premature. In her attachment, Schenck appears to restate some of the allegations in her complaint but also "allege[s] claims of reverse age and race discrimination under The Age in Discrimination in Employment Act of 1967 and Title VII of the Civil Rights Act of 1964." Id. at 2. It is unclear whether the plaintiff seeks to replace claims in, or add claims to, those in her complaint.In any event, the Court construes the plaintiff's letter as a motion to amend her complaint by attaching the letter to the complaint. See Graham v. Henderson, 89 F.3d 75, 79 (2d Cir. 1996) ("[T]he pleadings of a pro se plaintiff must be read liberally and should be interpreted to 'raise the strongest arguments that they suggest.'") May 26, 2021 Opinion or Order Filing 3 Order to Show CauseThe pro se plaintiff, Michelle Schenck, commenced this action on 05/21/2021. Docket Item #1 . That same day, she moved to proceed in forma pauperis. Docket Item #2 . In her application, Schenck states that her total gross monthly income is $2,748.00. Id. at 2. She also states that she receives $387.00 and $300.00 in "pandemic [and] unemployment" benefits. Id. at 1. Her total monthly expenses apparently consist of $600 for food and $400 for all other expenses; "[r]ent or mortgage" and "[u]tilities" are blank. Id. at 2. Schenck indicates that she lives with her domestic partner and that her partner contributes $2,000.00 in monthly expenses. Id.Based on the information in her application, Schenck's monthly household income and expenses are unclear. Cf. Fridman v. City of N. Y., 195 F. Indeed, her application suggests that she nets over $20,000 annually after all expenses are paid. If that is so, then she can afford the expenses associated with her lawsuit. Within 30 days of the date of this order, Schenck shall show cause why her application to proceed in forma pauperis should not be denied. Specifically, she should provide the Court with a clear total and breakdown of all gross monthly household income, detailing what amount is from outside sources and what amount is from her domestic partner. Schenck also should provide the Court with more details about her monthly expensesfor example, how much she pays in rent and utilities or why she does not pay rent and utilities and how much her domestic partner contributes to those and other expenses each monthas well as any other information that will help the Court decide her motion.
