Filing 17 TEXT ORDER granting #14 Motion for an Extension of Time, denying #16 Motion for Denial of Time, and denying #12 Motion to Appoint Counsel. The defendant's time to answer or otherwise respond to the amended complaint is extended until 12/29/2021. The plaintiff's motion to deny the extension is denied as moot. The pro se plaintiff also has asked this Court to appoint counsel for her. Docket Item #12 . In deciding whether to appoint counsel, courts first assess the plaintiff's likelihood of success on the merits of her claim. See Hodge v. Police Officers, 802 F.2d 58, 60-61 (2d Cir. 1986). If the claim meets this threshold requirement, courts consider a number of other factors, including "the nature of the factual issues the claim presents[,]... the plaintiff's apparent ability to present the case[,]... whether appointment of counsel would lead to a quicker and more just result by sharpening the issues and shaping examination[,]... [and the plaintiff's] efforts to obtain counsel." Id. at 61. The defendant has not yet answered the allegations in the complaint, so the only facts upon which this Court may base its decision as to whether this lawsuit is of substance are the plaintiff's bare allegations. At this stage, the Court lacks sufficient information to consider the factors stated in Hodge. The plaintiff's request for appointment of counsel therefore is denied without prejudice as premature. SO ORDERED. Issued by Hon. Lawrence J. Vilardo on 12/2/2021. (Chambers mailed a copy of this text order to the pro se plaintiff.) (WMH) |

Filing 9 TEXT ORDER:On 8/12/2021, the pro se plaintiff, Michelle Schenck, filed a notice of motion requesting that this Court "please see" an attached document. Docket Item #8 at 2. In her attachment, Schenck appears to restate some of the allegations in her complaint but also "allege[s] claims of reverse age and race discrimination under The Age in Discrimination in Employment Act of 1967 and Title VII of the Civil Rights Act of 1964." Id. at 2. It is unclear whether the plaintiff seeks to replace claims in, or add claims to, those in her complaint. In any event, the Court construes the plaintiff's letter as a motion to amend her complaint by attaching the letter to the complaint. See Graham v. Henderson, 89 F.3d 75, 79 (2d Cir. 1996) ("[T]he pleadings of a pro se plaintiff must be read liberally and should be interpreted to 'raise the strongest arguments that they suggest.'") (quoting Burgos v. Hopkins, 14 F.3d 787, 790 (2d Cir. 1994)). That motion is granted, and the plaintiff's letter, as well as Docket Items #6 and #7 , are added to the complaint. To the extent that the plaintiff wants her case to proceed promptly, she must first issue a summons (available at https://www.nywd.uscourts.gov/sites/nywd/files/ProSe_Forms_civSummons_AO_440.pdf). She may either file the summons directly or complete the form and return it to the Clerk of the Court. Once the summons has been issued, the plaintiff must then effect timely service. See Fed. R. Civ. P. 4. SO ORDERED. Issued by Hon. Lawrence J. Vilardo on 8/17/2021. (WMH) (Chambers mailed a copy of this order to the pro se plaintiff on 8/17/2021.) |

Filing 5 ORDER denying #2 Motion for Leave to Proceed in forma pauperis; that Plaintiff has 30 days from the date of this order to pay the $350.00 filing fee and the $52.00 adminisitrative fee ($402.00 total); that if Plaintiff does not submit payment or otherwise seek relief from this order within 30 days, the Clerk of Court shall close this case as dismissed without prejudice without further order of the Court. Signed by Hon. Lawrence J. Vilardo on 7/9/2021. (JLV) Copy mailed to pro se plaintiff. |
Filing 4 REPLY/RESPONSE to re 3 Order to Show Cause filed by Michelle A Schenck "Pro Se". (JLV) |
Filing 3 Order to Show CauseThe pro se plaintiff, Michelle Schenck, commenced this action on 05/21/2021. Docket Item #1 . That same day, she moved to proceed in forma pauperis. Docket Item #2 . In her application, Schenck states that her total gross monthly income is $2,748.00. Id. at 2. She also states that she receives $387.00 and $300.00 in "pandemic [and] unemployment" benefits. Id. at 1. Her total monthly expenses apparently consist of $600 for food and $400 for all other expenses; "[r]ent or mortgage" and "[u]tilities" are blank. Id. at 2. Schenck indicates that she lives with her domestic partner and that her partner contributes $2,000.00 in monthly expenses. Id.Based on the information in her application, Schenck's monthly household income and expenses are unclear. Cf. Fridman v. City of N. Y., 195 F. Supp. 2d 534, 537 (S.D.N.Y. 2002) (quoting Williams v. Spencer, 455 F. Supp. 205, 208-09 (D. Md. 1978)) ("In assessing an application to proceed in forma pauperis, a court may consider the resources that the applicant has or 'can get' from those who ordinarily provide the applicant with the 'necessities of life,' such as 'from a spouse, parent, adult sibling or other next friend.'"). Indeed, her application suggests that she nets over $20,000 annually after all expenses are paid. If that is so, then she can afford the expenses associated with her lawsuit. Within 30 days of the date of this order, Schenck shall show cause why her application to proceed in forma pauperis should not be denied. Specifically, she should provide the Court with a clear total and breakdown of all gross monthly household income, detailing what amount is from outside sources and what amount is from her domestic partner. Schenck also should provide the Court with more details about her monthly expensesfor example, how much she pays in rent and utilities or why she does not pay rent and utilities and how much her domestic partner contributes to those and other expenses each monthas well as any other information that will help the Court decide her motion. SO ORDERED. Issued by the Hon. Lawrence J. Vilardo on 05/26/2021. (SAV) (Chambers mailed a copy of this order to the pro se plaintiff) |
