As noted by the parties, this action could have been brought in the first instance in the DNJ as: (1) no Defendant resides in this district ; (2) the I-130 Petition is pending at the USCIS Newark, New Jersey Field Office; (3) at the time Plaintiffs filed the instant complaint resided in New Jersey and continue to reside there; (4) and no real property is involved in this action, thus satisfying all the requirements of 28 U.S.C. 1391(e)(1). Accordingly, the Court finds it is in the interest of justice to transfer this action to the DNJ and the Clerk of the Court is directed to transfer this case to the U.S. DISTRICT COURT FOR THE DISTRICT OF NEW JERSEY pursuant to 28 U.S.C. 1404(a) and to close this case.
