TEXT ORDER: Defendant's request for leave to file an application to disclose the names of the Individual OP Unit Holders under seal or to disclose the names of the Individual OP Unit Holders to the Court and opposing counsel in camera (Application) (ECF No. #9 ) is DENIED without prejudice. The parties are directed to confer as to whether defendant consents to the remand of this matter. If defendant does not consent, the Court directs defendant to file a letter-brief by March 18, 2024, which shall address the holdings in 3376 Lake Shore, LLC v. Lamb's Yacht Center, Inc., 2014 WL 12621574 (M.D. Fla. Aug. 25, 2014), Smith v. Westminster Management, LLC, 2018 WL 572867 (D. Md. Jan. 26, 2018), and MHA, LLC v. Siemens Healthcare Diagnostic, Inc., 2017 WL 838797 (D.N.J. Mar. 2, 2017). Defendant is also directed to conduct a good faith search of case law relevant to resolving the Application and provide citations to same. Plaintiff may file a response by March 29, 2024. The Application will be addressed at the initial scheduling conference scheduled for April 25, 2024 at 10:15 a.m. (ECF No. #7 ).
