CONSENT ORDER Capping Damages and Remanding Case to State Court: The total amount of damages that plaintiff may recover in this case shall not under any circumstances exceed $75,000. This limitation and cap on potential damages shall be binding on plaintiff in all future proceedings in this case, including in State Court after remand as well as any arbitration or appraisal proceeding.
