TEXT ORDER: This matter comes before the Court based on a review of its docket and the filing of Defendants' Motion to Dismiss (ECF No. #3 ) and Motion to Stay (ECF No. #4 ). This Court's individual preferences state that, "[i]n an effort to resolve cases expeditiously, before bringing a motion to dismiss, a party must submit a letter, not to exceed three (3) single-spaced pages, requesting a pre-motion conference within seven (7) days after receipt of this letter, all adversaries must submit a written response, not to exceed three (3) single-spaced pages." In order to facilitate this exchange, the Court will construe Defendants' Motion to Dismiss as Defendants' requests for a pre-motion conference in accordance with the Court's individual preferences, which may be found at # https://www.njd.uscourts.gov/content/georgette-castner. The Court recognizes that co-Defendant Dr. Haranath Policherla has not joined in the Motion to Dismiss (ECF No. #3 ) and instead filed a Motion to Stay (ECF No. #4 ), which does not normally require a pre-motion conference. However, given the nature of the motion, the Court will similarly construe the Motion to Stay as a pre-motion conference letter together with the Motion to Dismiss. By no later than December 8, 2023, Plaintiff shall file a letter, not exceeding three (3) pages single spaced, responding to Defendants' arguments in the Motion to Dismiss and Motion to Stay, including whether Plaintiff intends to file an amended complaint. After reviewing Plaintiffs letter, the Court will either schedule a pre-motion conference or reopen the motions and set a briefing schedule. The Court directs the Clerk to administratively terminate Defendants' Motion to Dismiss (ECF No. #3 ) and Motion to Stay (ECF No. #4 ) pending the Court's decision.
